1. About these Terms
1.1 These Terms and Conditions (Terms) govern access to and use of the UNICASH platform, including the website at unicash.com.au and any associated apps, services, content, and communications (together, the Platform), and Membership of, participation in, and purchases through the Platform.
1.2 The Platform is operated by [UNICASH Pty Ltd] (ABN [90 693 062 538]) of [45 St Georges Terrace, Perth WA 6000] (UNICASH, we, us, our).
1.3 By creating an Account, subscribing to a Membership, purchasing a Point Booster, submitting a Receipt, redeeming a Gift Card, entering a Draw, or otherwise using the Platform, you agree to these Terms, the Privacy Policy, the Refund Policy, and any applicable Promotion-Specific Terms. If you do not agree, you must not use the Platform.
1.4 These Terms constitute a binding agreement between you and UNICASH. Headings are for convenience only and do not affect interpretation.
1.5 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) (ACL) or any other law that cannot lawfully be excluded.
2. Definitions
In these Terms, capitalised words have the following meanings:
Account — the registered user account of a Member on the Platform.
Bonus Draw — a promotional draw offered to eligible Members from time to time, including flash, themed, seasonal, and member-only draws.
Draw — any promotion conducted by UNICASH in which Members may participate, including Major Draws, Bonus Draws, and any other promotional draws notified through the Platform.
Eligible Member — a Member who meets the eligibility requirements of these Terms and any applicable Promotion-Specific Terms.
Fuel Rewards — a non-cash promotional balance earned by Members through Scan Receipts and any other eligible activities specified on the Platform, and used for the benefits described on the Platform.
Gift Card — a digital gift card from a participating retailer brand, made available to Eligible Members for redemption with Points through a Gift Card Provider.
Gift Card Provider — the third-party provider that issues, fulfils, and delivers Gift Cards on behalf of UNICASH. The current Gift Card Provider is Prezzee Pty Ltd; UNICASH may add or substitute Gift Card Providers on reasonable notice.
Major Draw — a flagship weekly, monthly, or milestone Draw conducted by UNICASH, in which entries may be allocated as a Membership Benefit or acquired through the use of Points.
Member — a natural person who has created an Account and holds an active Membership.
Membership — a recurring subscription to one of UNICASH's membership tiers (currently UniOne, UniPlus, and UniMax, or any tier that replaces or supplements them).
Membership Benefits — the benefits included in each Membership tier, which may include monthly promotional Points, Major Draw entries, early access to selected Bonus Draws, and other features.
Personal Information — has the meaning given in the Privacy Act 1988 (Cth).
Point — a non-monetary, non-transferable digital promotional unit issued by UNICASH that may be used by Members to participate in eligible Draws, to redeem Gift Cards, and for other Platform features. Points have no cash value and are not legal tender, electronic money, a financial product, stored value, or a security.
Point Booster — a one-off, non-recurring purchase of a fixed quantity of Points (currently designated Booster Spark, Booster Pulse, and Booster Surge).
Promotion-Specific Terms — the additional rules, eligibility criteria, prize description, entry mechanics, and conditions applicable to a particular Draw or promotion.
Prize — the item, voucher, gift card, experience, cash, or other reward made available to one or more winners of a Draw, as described in the relevant Promotion-Specific Terms.
Receipt — an image, photograph, or digital record of a retail transaction submitted by a Member to the Platform under the Scan Receipts feature.
Recipient — in relation to a Gift Card redemption, the natural person (the Member or a person nominated by the Member) to whom the Gift Card is to be delivered.
Restricted Jurisdiction — any state, territory, or country in which participation in a Draw, holding a Membership, or use of the Platform is unlawful, restricted, or requires a permit that UNICASH does not hold for that location, including (where applicable) [South Australia] and any other jurisdiction listed in the relevant Promotion-Specific Terms.
Scan Receipts — the Platform feature that allows Members to submit Receipts to earn Points, Fuel Rewards, or other eligible benefits.
Terms — these Terms and Conditions, as amended from time to time.
You / your — the individual using the Platform.
Words importing the singular include the plural and vice versa. "Includes" and "including" are not words of limitation.
3. Eligibility
3.1 Age. A Member must be at least 18 years of age to create an Account, purchase a Membership, purchase a Point Booster, submit a Receipt, redeem a Gift Card, or enter a Draw, except where Promotion-Specific Terms require a higher age.
3.2 Capacity. A Member must have legal capacity to enter into binding contracts in their jurisdiction.
3.3 Residency. A Member must be a resident of Australia, unless Promotion-Specific Terms expressly permit otherwise.
3.4 One Account per person. Each individual may hold one Account only. Multiple, duplicate, syndicate, or shared Accounts are not permitted.
3.5 Identity. You must register using your own, accurate, current, and complete legal name and contact details, and must keep that information up to date.
3.6 Restricted persons. You must not use the Platform if you are: (a) resident in a Restricted Jurisdiction in relation to the relevant feature; (b) the subject of a current UNICASH Account suspension or termination; (c) acting on behalf of another person without UNICASH's written consent; (d) an employee, contractor, agent, or immediate family member of any party involved in conducting the relevant Draw, except where Promotion-Specific Terms expressly permit; or (e) prohibited by applicable law from participating.
3.7 Identity verification. UNICASH may at any time require reasonable identity, age, residency, or payment verification, including production of government-issued identification. UNICASH may suspend Account features, withhold Prizes, or refuse Draw entries, Receipt submissions, or Gift Card redemptions until verification is satisfactorily completed.
4. Accounts
4.1 Creating an Account. An Account is created by providing the information requested at sign-up and accepting these Terms.
4.2 Account security. You are responsible for keeping your login credentials secure. You must not share, sell, transfer, or licence your Account. You are responsible for all activity that occurs under your Account, except to the extent caused by UNICASH's breach.
4.3 Notification. You must notify UNICASH promptly at support@unicash.com.au if you become aware of any unauthorised access to, or use of, your Account.
4.4 Accuracy of information. You warrant that information provided to UNICASH is true, accurate, current, and complete, and that you will keep it up to date.
4.5 Suspension or termination. Without limiting any other right, UNICASH may suspend, restrict, or terminate an Account, withhold Membership Benefits, cancel Draw entries, reverse Receipt rewards, refuse or reverse Gift Card redemptions, or void Prizes where UNICASH reasonably suspects:
(a) fraud, attempted fraud, or money laundering; (b) chargeback abuse, payment reversal, or unauthorised payment; (c) creation of duplicate, automated, or fictitious Accounts; (d) misrepresentation of identity, age, or residency; (e) manipulation, gaming, or abuse of Draws, Points, Memberships, Scan Receipts, Gift Card redemptions, or any other promotion or Platform feature; (f) breach of these Terms, any Promotion-Specific Terms, or applicable law; (g) conduct that is harmful, abusive, threatening, or unlawful; or (h) any other circumstance permitted by these Terms or required by law.
4.6 Account closure by Member. A Member may close their Account at any time by following the cancellation steps described in clause 14 and on the Platform. Account closure does not refund Membership fees or Point Booster purchases, except as required by law or under the Refund Policy.
5. Website and Platform Use
5.1 Licence. Subject to your compliance with these Terms, UNICASH grants you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes.
5.2 Availability. The Platform is provided on an "as available" basis. UNICASH does not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components, except to the extent required by the ACL.
5.3 Changes. Subject to applicable law, UNICASH may modify, suspend, withdraw, or discontinue the Platform or any of its features (including any Membership tier, Point Booster, Membership Benefit, Scan Receipts function, Gift Card brand or denomination, or Draw) at any time. Where reasonably practicable, UNICASH will give Members reasonable advance notice of material changes that adversely affect paid Memberships.
5.4 Third-party services. The Platform may integrate with or link to third-party services, including payment processors, the Gift Card Provider, optical character recognition (OCR) providers, and email and SMS providers. UNICASH is not responsible for those third-party services, which are governed by their own terms.
6. Memberships
6.1 Membership tiers
UNICASH offers Membership tiers including (at the date of these Terms):
(a) UniOne — [A$19.99] per month; (b) UniPlus — [A$49.99] per month; and (c) UniMax — [A$99.99] per month.
The price, inclusions, and Benefits of each tier are described on the Platform and may be updated in accordance with clause 19.
6.2 Membership Benefits
6.2.1 Each Membership tier includes monthly Membership Benefits, which may include: (a) entries into specified Major Draws; (b) monthly promotional Points; (c) early access to selected Bonus Draws; and (d) such other benefits as UNICASH describes on the Platform.
6.2.2 Membership Benefits are promotional, are not cash, have no monetary value, and are not transferable. They are issued solely for use within the Platform and are not redeemable for money, except where required by law.
6.2.3 Membership Benefits reset at the start of each billing cycle. Unless UNICASH expressly states otherwise on the Platform or in the relevant Promotion-Specific Terms, Membership Benefits (including monthly promotional Points and entry allocations) do not roll over to future billing cycles and are forfeited if unused.
6.2.4 The mix of Benefits within a tier may change. Where a change materially reduces the value of an active paid Membership, UNICASH will give reasonable prior notice and, where appropriate, a right to cancel before the change takes effect.
6.3 Auto-renewal
6.3.1 Membership renews automatically at the end of each billing cycle for a further cycle of the same length, at the then-current price of the Member's Membership tier, until cancelled in accordance with clause 6.5.
6.3.2 By subscribing to a Membership, the Member authorises UNICASH (and its payment processor) to charge the payment method on file for each renewal automatically, without further action by the Member.
6.3.3 If a renewal payment fails, UNICASH may: (a) retry the charge in accordance with the payment processor's settings; (b) notify the Member to update the payment method; (c) suspend or downgrade Membership Benefits; and (d) cancel the Membership if payment is not received within a reasonable period.
6.3.4 The Member will receive a renewal notice or charge confirmation in accordance with applicable law. The Member is responsible for keeping the payment method current.
6.4 Free trials and promotional pricing
Where UNICASH offers a free trial, discounted introductory price, or promotional Membership, the trial or promotional rate applies only for the period stated. At the end of that period, the Membership will convert to a paid Membership at the standard advertised price unless cancelled before the period ends.
6.5 Cancellation by Member
6.5.1 A Member may cancel their Membership at any time using the cancellation function in Account settings or by emailing support@unicash.com.au.
6.5.2 Cancellation takes effect at the end of the current billing cycle. Membership Benefits remain available until that date, except where UNICASH is required by law or by these Terms to terminate access earlier.
6.5.3 Cancellation does not entitle the Member to a refund of fees already paid, except as required by law or under the Refund Policy. Cancellation does not cancel Draw entries already validly submitted before the cancellation date, except where UNICASH cancels the Account under clause 4.5.
6.5.4 On expiry of the final billing cycle, any unused Membership Benefits (including unused promotional Points) are forfeited.
6.6 Suspension and downgrade
UNICASH may suspend or downgrade a Membership where: (a) a payment fails; (b) UNICASH is reasonably investigating suspected fraud, abuse, or breach of these Terms; (c) the Member initiates or threatens a chargeback; or (d) UNICASH is required by law or a competent authority to do so.
7. Point Boosters and Points
7.1 Point Boosters are one-off purchases
7.1.1 Point Boosters are one-time, non-recurring purchases of a fixed quantity of Points. They do not auto-renew. A Member may purchase Point Boosters in addition to, or independently of, a Membership.
7.1.2 The price, name, and Points included in each Point Booster are displayed on the Platform at the time of purchase.
7.2 Issue of Points
7.2.1 Points purchased through a Point Booster are credited to the Member's Account after successful payment confirmation.
7.2.2 Points awarded under Membership Benefits are issued in accordance with clause 6.2.
7.2.3 Points awarded through Scan Receipts are issued in accordance with clause 8.
7.2.4 Points may be reversed where payment is reversed, charged back, declined, or otherwise not received in cleared funds, or where reversal is required to correct fraud, error, or breach.
7.3 Nature of Points
7.3.1 Points are a promotional in-Platform unit. They:
(a) are not cash, currency, or legal tender; (b) are not a financial product, electronic money, stored value, payment instrument, or security; (c) have no cash value and are not redeemable for cash, except where required by law; (d) are not transferable between Accounts or to any third party; and (e) are issued solely for use within the Platform.
7.3.2 Points are not the property of the Member. They represent a limited, revocable right to participate in Draws, redeem Gift Cards, and use other eligible features of the Platform on the terms set out in these Terms and any Promotion-Specific Terms.
7.4 Expiry and roll-over
7.4.1 Points purchased through a Point Booster do not expire and are not subject to the monthly reset described in clause 6.2.3, unless otherwise stated on the Platform or in the relevant Promotion-Specific Terms. UNICASH may introduce expiry periods for new Point Booster issuances on reasonable notice, subject to applicable law.
7.4.2 Promotional Points included in a Membership reset at the end of each billing cycle in accordance with clause 6.2.3.
7.4.3 Where both purchased and promotional Points are held in an Account, Points may be deducted in the order described on the Platform (typically promotional Points first, then purchased Points), to maximise the benefit of the non-expiring balance.
7.5 Refunds
7.5.1 Point Boosters are digital products supplied immediately on purchase. By purchasing a Point Booster, the Member expressly consents to immediate supply and acknowledges that, to the extent permitted by law, Point Boosters are non-refundable once Points are credited to the Account, except where required by the ACL or where UNICASH has agreed to a refund in writing.
7.5.2 The Refund Policy sets out the circumstances in which UNICASH will consider refund requests outside the ACL guarantees.
8. Scan Receipts
8.1 Overview
The Scan Receipts feature allows Members to submit eligible Receipts to earn Points, Fuel Rewards, or other eligible benefits as described on the Platform. Participation in Scan Receipts is voluntary.
8.2 Eligible Receipts
8.2.1 A Receipt is eligible for reward only if all of the following are satisfied:
(a) it relates to a genuine retail transaction undertaken by the Member, in the Member's own name, and at the Member's own expense; (b) it is from a participating Australian retailer or transaction type listed (or otherwise indicated as eligible) on the Platform; (c) it is legible and clearly shows the retailer name, transaction date and time, line items, total amount, and (where displayed on the original receipt) the payment method; (d) the transaction date is within the eligibility window specified on the Platform (currently [30 days] from the date of submission); and (e) the Receipt has not previously been submitted to UNICASH by the Member or any other Member.
8.2.2 UNICASH may exclude particular retailers, product categories, payment methods, or transaction types from eligibility (including alcohol, tobacco, fuel surcharges, lottery products, gift cards purchased at retail, refunded items, and transactions specifically excluded by a retailer partner). The current list of exclusions is published on the Platform.
8.3 Submission process
8.3.1 A Receipt is submitted by uploading a clear photograph or digital scan of the original Receipt through the Platform. Only one image per Receipt may be submitted unless the Platform expressly supports multi-image capture (for example, a long-format Receipt).
8.3.2 Each submission passes through one or more processing states, including uploading, scanning, success, pending review, approved, rejected, duplicate, invalid Receipt, and processing failure. The current state of a submission is displayed in the Account.
8.4 Review and determination
8.4.1 UNICASH may use automated review (including OCR, image hashing, perceptual hashing, transaction fingerprinting, velocity checks, and pattern detection) and manual review to determine the eligibility and reward value of a Receipt.
8.4.2 Some submissions may require manual review. The Member acknowledges that the review period may take up to [7] business days, and longer in exceptional circumstances (including high volume, suspected fraud, or where additional information is required).
8.4.3 UNICASH's determination of Receipt eligibility and reward value is final, subject to applicable law and the dispute process in clause 8.7.
8.5 Crediting of rewards
8.5.1 Approved Points or Fuel Rewards are credited to the Account on approval. Rewards are promotional, are not cash, have no cash value, and (in the case of Points) are subject to clause 7.3. Fuel Rewards are subject to the rules published on the Platform.
8.5.2 If a reward is credited and the underlying Receipt is subsequently found to be ineligible, fraudulent, duplicated, refunded, returned, or otherwise invalid, UNICASH may reverse the reward in whole or in part at any time, even where the rewarded balance has been used, and may suspend or terminate the Account in accordance with these Terms.
8.6 Prohibited Receipt conduct
A Member must not, and must not attempt to:
(a) submit a Receipt for a transaction not personally undertaken by the Member; (b) submit a Receipt that has been altered, edited, fabricated, digitally generated, AI-generated, photographed from another screen, or otherwise manipulated; (c) submit the same Receipt more than once (whether under the Member's Account or any other Account, and whether as the same or a different image of the same transaction); (d) submit a Receipt for a transaction that has been refunded, reversed, returned, or cancelled (whether before or after submission); (e) submit a Receipt that is illegible or that materially obscures required information; (f) submit Receipts on behalf of another person without that person's authority; (g) collude with any other person to inflate, manipulate, or share rewards earned through Scan Receipts; or (h) circumvent or attempt to circumvent any eligibility, frequency, throttle, hash check, or anti-fraud control imposed by UNICASH.
A breach of this clause 8.6 may result in rejection of the submission, reversal of credited rewards, forfeiture of Points and Fuel Rewards, suspension or termination of the Account, recovery by UNICASH of any loss caused, and in serious cases referral to law enforcement.
8.7 Disputes
A Member who disputes the rejection of a Receipt or the reversal of a reward may request a review by contacting support@unicash.com.au within [30] days of the relevant decision. The outcome of the review will be communicated in writing.
8.8 No purchase obligation; no retailer affiliation
8.8.1 A Member is not required to make any purchase to use the Platform. Where a Member makes a purchase, the relationship is between the Member and the retailer. UNICASH is not a party to that transaction and is not responsible for the products, prices, returns, warranties, or after-sales service of any retailer.
8.8.2 The display of a retailer's name, logo, or branding on the Platform does not imply sponsorship, endorsement, or partnership by that retailer unless expressly stated.
8.9 Privacy of Receipt data
The information provided when submitting a Receipt (including the Receipt image, OCR-extracted text, image hashes, perceptual hashes, and transaction fingerprints) is handled in accordance with the Privacy Policy. Receipts and associated data are retained only for so long as is reasonably necessary for the purposes set out in that Policy.
9. Redeem Gift Cards
9.1 Overview
The Redeem Gift Cards feature allows Eligible Members to use Points to redeem digital Gift Cards from participating retailer brands. Gift Cards are issued, fulfilled, and delivered by the Gift Card Provider, not by UNICASH. UNICASH facilitates the redemption between the Member and the Gift Card Provider.
9.2 Available brands, denominations, and conversion rate
9.2.1 The available brands, denominations, redemption limits, and Points-to-AUD conversion rate (the Conversion Rate) are displayed on the Platform and may change at UNICASH's reasonable discretion.
9.2.2 The Conversion Rate displayed at the time the Member confirms a redemption applies to that order. UNICASH may apply a minimum redemption amount, a maximum redemption amount per order, and aggregate limits per day, per Account, or per brand.
9.3 Recipient details
9.3.1 A Member may redeem a Gift Card for themselves or for a Recipient other than themselves. Where the Member nominates a Recipient other than themselves, the Member warrants that:
(a) the Member has the Recipient's authority to provide the Recipient's email address, name, and any gift message; (b) the Member has informed the Recipient that the Recipient's Personal Information will be passed to the Gift Card Provider for delivery; and (c) the gift message complies with the prohibited conduct provisions of clause 15 (and in particular is not unlawful, abusive, threatening, defamatory, infringing, or otherwise inappropriate).
9.3.2 The Member is responsible for the accuracy of all Recipient details. UNICASH is not liable for any delivery failure, mis-delivery, or non-receipt caused by an incorrect email address or other inaccurate Recipient information provided by the Member.
9.4 Confirmation and Points deduction
9.4.1 On confirmation of a Gift Card redemption, the corresponding Points are deducted from the Member's Account and a redemption order is submitted to the Gift Card Provider.
9.4.2 Redemption orders pass through one or more processing states, including holding points, submitting, pending with provider, pending payment, pending fulfilment, pending delivery, completed, failed, and refunded. The current state of a redemption is visible in the Account.
9.4.3 Redemption orders are processed as quickly as is reasonably practicable, however UNICASH does not guarantee a specific delivery time. Delivery is dependent on the Gift Card Provider's systems and on email infrastructure outside UNICASH's control.
9.5 Delivery model
9.5.1 The Gift Card Provider delivers the Gift Card (including the redemption code and any PIN) directly to the Recipient by email on behalf of UNICASH. UNICASH does not receive, hold, or store the Gift Card code or PIN at any time.
9.5.2 The Member and the Recipient acknowledge that delivery depends on email infrastructure (including spam filters, mailbox provider availability, and the accuracy of the Recipient email address) outside UNICASH's control.
9.5.3 UNICASH may display delivery telemetry in the Account (such as "queued", "delivered", "opened", or "clicked"), based on information provided by the Gift Card Provider. Telemetry is provided for information only.
9.5.4 Where the gift email has not been received within a reasonable period, the Member may request a resend by contacting support@unicash.com.au. Resend support is available for a limited period after the redemption date, as published on the Platform.
9.6 Failed redemptions
9.6.1 Where a redemption order fails before the Gift Card is issued and delivered by the Gift Card Provider (for example, where the brand is out of stock, the request is invalid, or the Gift Card Provider's system returns an error), the deducted Points will be re-credited to the Member's Account. UNICASH will notify the Member of the failure.
9.6.2 Where a redemption order fails after the Gift Card has been issued but before delivery is confirmed (for example, where the delivery email is rejected by the Recipient's mail server), UNICASH will work with the Member and the Gift Card Provider to attempt redelivery, subject to the Gift Card Provider's policies and applicable law.
9.7 Finality of redemption and Gift Card refunds
9.7.1 Once a Gift Card has been successfully issued and delivered, the redemption is final. Points are not refundable after successful issue and delivery of the Gift Card, except where required by law.
9.7.2 Gift Cards are not refundable, exchangeable, or redeemable for cash, except where required by law. Use, balance, expiry, replacement, and disputes relating to a Gift Card are governed by the terms of the issuing retailer brand and the Gift Card Provider.
9.8 Third-party brand and Gift Card Provider terms
9.8.1 Each Gift Card is governed by the terms and conditions of the issuing retailer brand and the Gift Card Provider, which may include rules regarding:
(a) where the Gift Card may be used; (b) the expiry date of the Gift Card; (c) loss, theft, sharing, or unauthorised use; (d) restrictions on combining the Gift Card with other promotions; and (e) refunds, replacements, balance enquiries, and disputes relating to the Gift Card itself.
9.8.2 UNICASH is not the issuer or merchant of the Gift Card and is not responsible for the goods or services for which a Gift Card may be redeemed. Disputes about products purchased with a Gift Card are between the Recipient and the relevant retailer.
9.8.3 The display of a retailer brand on the Platform does not imply sponsorship or endorsement of UNICASH by that brand unless expressly stated.
9.9 Fraud, abuse, and risk
9.9.1 UNICASH may delay, refuse, reverse, or cancel a redemption where UNICASH reasonably suspects fraud, abuse, chargeback risk, account compromise, sanctions risk, or breach of these Terms.
9.9.2 UNICASH may require identity verification before processing certain redemptions, including high-value, high-velocity, or first-time orders.
9.9.3 Where a redemption is reversed under this clause, UNICASH may re-credit, hold, or forfeit the affected Points as appropriate to the circumstances and subject to applicable law.
9.10 Privacy of redemption data
The Personal Information provided for a Gift Card redemption (including Recipient email address, Recipient first name, gift message, selected gift style, and order metadata) is disclosed to the Gift Card Provider for fulfilment and delivery, in accordance with the Privacy Policy.
10. Draws and Promotions
10.1 Types of Draws
UNICASH may operate:
(a) Major Draws, including weekly, monthly, and milestone draws; (b) Bonus Draws, including flash, themed, seasonal, and member-only draws; and (c) Promotional Draws of limited duration.
10.2 Promotion-Specific Terms
10.2.1 Each Draw is governed by its own Promotion-Specific Terms, which may include:
(a) prize description and value (and any cash alternative); (b) start and end times (Australian Eastern Time unless otherwise stated); (c) entry method and Points required per entry; (d) maximum entrants or maximum entries per Member; (e) eligibility criteria, including any Membership tier requirement; (f) winner selection method and timing; (g) prize delivery method, timing, and verification requirements; (h) Restricted Jurisdictions; (i) trade promotion permit numbers (for example, NSW Permit No. [Permit Number], ACT Permit No. [Permit Number]) where applicable; and (j) any additional rules required by law.
10.2.2 Promotion-Specific Terms prevail over these Terms to the extent of any inconsistency, except where these Terms reflect a mandatory requirement of law.
10.3 Entry mechanics
10.3.1 Entry into a Draw is open to Eligible Members only. Some Draws permit only one entry per Member; others permit multiple entries up to a cap stated in the Promotion-Specific Terms.
10.3.2 Where entry requires Points, the relevant number of Points is deducted from the Account at the time the Member confirms entry.
10.3.3 Entry is final once confirmed. Once Points have been deducted and entry has been registered, the entry may not be withdrawn, reversed, or refunded, except where required by law or where UNICASH determines that the entry is invalid, fraudulent, duplicate, or in breach of these Terms or the relevant Promotion-Specific Terms.
10.3.4 A Draw closes on the earlier of: (a) the advertised closing time; (b) the cap on entrants or entries being reached; and (c) the Draw being cancelled, suspended, or withdrawn under these Terms.
10.3.5 Entries that are incomplete, illegible, late, automated, generated by bot or script, suspected of being fraudulent, made by ineligible persons, or otherwise in breach of these Terms or the Promotion-Specific Terms may be disqualified at UNICASH's reasonable discretion.
10.4 Winner selection
10.4.1 Winners are determined in the manner described in the Promotion-Specific Terms, which may include random electronic draw, skill-based judging, or such other method as is lawful in the relevant jurisdiction.
10.4.2 The date, time, and location of the draw will be set out in the Promotion-Specific Terms or as required by an applicable trade promotion permit.
10.4.3 UNICASH's records of entries, draw conduct, and results are conclusive in the absence of manifest error.
10.5 Nature of the Platform
UNICASH operates a consumer membership and rewards platform. Draws conducted on the Platform are promotional in nature. Where a Draw constitutes a regulated trade promotion under state or territory law, UNICASH will conduct that Draw in accordance with the requirements of that law and any required permit.
10.6 Cancellation, suspension, or variation of a Draw
10.6.1 UNICASH may, at its reasonable discretion and subject to applicable law, suspend, vary, withdraw, or cancel a Draw where:
(a) required by law, regulator, or court order; (b) the Draw cannot be conducted as planned due to fraud, technical malfunction, system or network failure, cyber-attack, data corruption, or any other event outside UNICASH's reasonable control; (c) errors in pricing, listing, prize description, or eligibility require correction; (d) the integrity, security, or fairness of the Draw is materially compromised; or (e) other circumstances make it impracticable to conduct the Draw fairly.
10.6.2 Where a Draw is cancelled before entries are accepted, Points deducted will be re-credited. Where a Draw is cancelled or varied after entries have been accepted, UNICASH will determine an equitable remedy consistent with applicable law and any trade promotion permit, which may include re-crediting Points, substituting a Prize of equal or greater value, or running a replacement Draw.
10.7 Prizes
10.7.1 Prizes are as described in the relevant Promotion-Specific Terms.
10.7.2 Prize substitution. If a Prize becomes unavailable for reasons outside UNICASH's reasonable control, UNICASH may substitute a Prize of equal or greater value, subject to applicable law and any trade promotion permit.
10.7.3 No transfer. Prizes are not transferable or exchangeable and, unless expressly stated, are not redeemable for cash.
10.7.4 Tax. Winners are responsible for any tax, duty, excise, or other personal reporting obligation arising from receipt of a Prize. UNICASH does not provide tax advice and recommends that winners seek independent advice.
10.7.5 Delivery. Prizes are delivered or made available in the manner described in the Promotion-Specific Terms. Delivery to the address or contact details on file is at the winner's risk.
10.7.6 Unclaimed Prizes. Where a winner cannot be contacted, fails to respond to reasonable contact attempts, fails to verify identity, fails to claim a Prize within the period specified in the Promotion-Specific Terms (and in any event within the period required by the applicable trade promotion permit), or is found ineligible, the Prize may be forfeited and a redraw conducted in accordance with the Promotion-Specific Terms and applicable law.
11. Winner Verification and Publicity
11.1 Verification. Before a Prize is awarded, UNICASH may require the winner to:
(a) verify identity, age, and residency (including by producing government-issued identification); (b) confirm that the entry complies with these Terms and the Promotion-Specific Terms; (c) confirm that the winner is not a restricted person (within the meaning of clause 3.6); and (d) execute reasonable documentation (such as a winner declaration, release, or tax form) consistent with applicable law.
11.2 Disqualification. A winner who cannot satisfactorily complete verification, or who is found to be ineligible, may be disqualified and a redraw may be conducted.
11.3 Publicity consent. By entering a Draw, each entrant consents (to the extent permitted by law) to UNICASH publishing reasonably necessary winner information on the Platform, in marketing channels, and on social media for transparency and proof-of-conduct purposes, including:
(a) first name, surname initial, suburb, and state or territory; (b) Prize won and Draw identifier; (c) Draw date; and (d) a non-identifying photograph or video, where the winner has separately agreed.
11.4 Withdrawal of consent. A winner may request that UNICASH withhold publicity information by contacting support@unicash.com.au before the relevant Draw closes. UNICASH will accommodate that request where doing so does not breach an applicable trade promotion permit condition or other legal requirement.
11.5 No endorsement. Publication of winner information is for transparency only and does not imply endorsement of UNICASH by the winner unless separately agreed.
12. Restricted Jurisdictions
12.1 Memberships, Draws, and Platform features may be void, unavailable, or restricted in certain states, territories, or countries due to law, regulation, or permit conditions.
12.2 The Restricted Jurisdictions applicable to a particular Draw are set out in its Promotion-Specific Terms. [Subject to legal review: residents of South Australia and any other jurisdiction listed in the Promotion-Specific Terms may be excluded from participation in particular Draws where required by law.]
12.3 The Member is responsible for ensuring that the Member's use of the Platform is lawful in the Member's jurisdiction. UNICASH may refuse, cancel, or void any Account, Membership, purchase, Receipt submission, Gift Card redemption, entry, or Prize that originates from a Restricted Jurisdiction or that breaches applicable law.
12.4 UNICASH makes no representation that the Platform or any Draw is appropriate or lawful for use in any jurisdiction outside Australia.
13. Billing and Payment
13.1 Payment methods and processors. Accepted payment methods are displayed at checkout and may include credit and debit cards (Visa, Mastercard, and American Express) and digital wallets (such as Apple Pay and Google Pay). PayPal may be made available as an alternative checkout option. Card and wallet processing is performed by third-party payment processors notified on the Platform from time to time. As at the date of these Terms, the principal payment processor is Stripe Payments Australia Pty Ltd [ABN to be verified] (operating in conjunction with the Stripe group of companies). UNICASH may add, change, or replace its payment processors on reasonable notice, without requiring amendment of these Terms. Card and wallet credentials are submitted by the Member directly to the relevant payment processor through secure infrastructure; UNICASH does not store cardholder primary account numbers, card verification values, or wallet credentials. Processing of Personal Information by payment processors is also addressed in the Privacy Policy.
13.2 Authority to charge. By providing a payment method, the Member authorises UNICASH (and its payment processor) to charge that method for:
(a) the initial Membership fee or Point Booster purchase price; (b) each subsequent renewal of an active Membership at the then-current price; (c) applicable taxes (including GST where applicable); (d) any further fees or charges authorised by the Member on the Platform; and (e) any reasonable adjustment arising from a refund, reversal, or correction.
13.3 Currency and tax. All prices are displayed in Australian dollars (AUD) and, where applicable, are inclusive of GST. Prices may be updated, with prospective effect for new purchases and (subject to reasonable notice) for future renewals.
13.4 Failed payments. If a payment fails, UNICASH may retry the charge in accordance with the payment processor's standard retry logic, notify the Member to update the payment method, suspend Membership Benefits, or cancel access until payment is received.
13.5 Chargebacks. Where a Member initiates a chargeback or payment reversal that is not the result of unauthorised use of the Member's payment method, UNICASH may suspend the Account, void any related entries, Receipt rewards, Gift Card redemptions, or Prizes, and recover the amount disputed plus reasonable costs. Where UNICASH considers the chargeback fraudulent, UNICASH may report the matter to law enforcement and the relevant payment provider.
13.6 Records. Records produced by UNICASH's systems and its payment processors are conclusive evidence of payment, entry, and Account activity in the absence of manifest error.
13.7 Receipts and invoices. Tax receipts and invoices are available through the Account.
14. Cancellations and Refunds
14.1 Cancellation of Membership is governed by clause 6.5.
14.2 No cooling-off for digital products. Memberships, Point Boosters, and Gift Card redemptions are digital subscriptions or digital products supplied immediately on payment or on redemption. By purchasing or redeeming, the Member expressly consents to immediate supply and acknowledges that, to the extent permitted by law, statutory cooling-off rights for distance or online sales do not apply to immediate-supply digital products.
14.3 ACL rights preserved. This clause 14 does not limit the consumer guarantees under the ACL. Where a consumer guarantee is breached, the Member is entitled to a remedy under the ACL, which may include repair, replacement, or refund.
14.4 Goodwill refunds. Outside the statutory ACL rights, UNICASH may at its discretion offer a refund, partial refund, or Point credit in accordance with the Refund Policy. Any such resolution is provided without admission of liability.
14.5 Effect of cancellation. On Membership cancellation:
(a) the Member retains access to Membership Benefits until the end of the current billing cycle; (b) Draw entries already validly submitted remain valid, unless cancelled by UNICASH under clause 4.5 or 10.6; (c) Gift Card redemptions already successfully delivered are final; (d) Points purchased through a Point Booster remain in the Account, subject to clause 7.4, until the Account is closed or for such period as UNICASH reasonably maintains inactive accounts; and (e) unused promotional Points and unused Membership Benefits are forfeited.
14.6 Account closure. Where an Account is closed (by the Member or by UNICASH for cause), remaining Points, Fuel Rewards, Membership Benefits, and Draw entry rights are extinguished, except to the extent the law requires otherwise.
15. Prohibited Conduct
The Member must not, and must not attempt to:
(a) use the Platform for any unlawful purpose or in breach of any law, regulation, or court order; (b) create more than one Account, or use another person's Account; (c) impersonate any person or misrepresent identity, age, or residency; (d) interfere with, disrupt, or circumvent the security, integrity, or proper operation of the Platform; (e) use bots, scrapers, automated tools, scripts, or any other means to interact with the Platform, including to create Accounts, enter Draws, submit Receipts, or extract content; (f) reverse engineer, decompile, or disassemble any part of the Platform, except to the extent expressly permitted by law; (g) submit false, misleading, or fraudulent information, including in connection with Receipt submissions, Draw entries, Gift Card redemptions, winner verification, or chargebacks; (h) submit altered, edited, fabricated, AI-generated, or otherwise manipulated Receipts in breach of clause 8.6; (i) abuse, manipulate, or game the Gift Card redemption flow in breach of clause 9, including by misrepresenting Recipient details or attempting to obtain Gift Cards without bona fide entitlement to the underlying Points; (j) manipulate, attempt to manipulate, or collude with others to manipulate any Draw outcome, Membership Benefit, Point balance, Fuel Rewards balance, Scan Receipts reward, Gift Card redemption, or any other promotion; (k) copy, reproduce, distribute, publicly display, modify, or create derivative works of any Platform content, branding, code, or promotional material, except as expressly permitted in clause 16; (l) introduce viruses, malware, ransomware, or other harmful code to the Platform; (m) harass, abuse, threaten, or otherwise harm any user, employee, or representative of UNICASH; or (n) use the Platform in any way that imposes an unreasonable or disproportionate load on UNICASH's infrastructure.
UNICASH may investigate, take action against, and refer to law enforcement any breach of this clause 15.
16. Intellectual Property
16.1 Ownership. All intellectual property rights in and to the Platform, including software, source code, design, branding, trademarks, logos, layouts, content, copy, graphics, photography, and the "UNICASH" name and marks, are owned by or licensed to UNICASH and are protected by Australian and international intellectual property laws.
16.2 Limited licence. Subject to clause 5.1, UNICASH grants the Member a limited, personal, non-exclusive, non-transferable, revocable licence to view, access, and use the Platform for personal, non-commercial purposes. No other rights are granted.
16.3 User-submitted content. By submitting content to the Platform (for example, in a profile, support enquiry, marketing competition, gift message, or any other user input), the Member grants UNICASH a worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to use, reproduce, modify, display, and distribute that content for the purposes of operating and promoting the Platform, in accordance with applicable law and the Privacy Policy. The Member warrants that the Member has the right to grant that licence and that the content does not infringe any third-party right or law.
16.4 Feedback. Suggestions or feedback provided by the Member may be used by UNICASH without obligation or compensation, subject to applicable law.
16.5 Trademarks. Third-party trademarks (including the trademarks of retailer brands whose Gift Cards are made available on the Platform) are the property of their respective owners and are used for identification purposes only.
17. Liability and Disclaimers
17.1 Consumer guarantees. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the ACL or any other applicable law that cannot lawfully be excluded.
17.2 Other warranties excluded. To the maximum extent permitted by law, and other than as required by the ACL, UNICASH excludes all express and implied warranties, conditions, guarantees, and representations relating to the Platform, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement.
17.3 Limitation of liability. To the maximum extent permitted by law:
(a) UNICASH's total aggregate liability to the Member, in contract, tort (including negligence), under statute, or otherwise, arising out of or in connection with these Terms or the Platform, is limited to the greater of (i) the total amount paid by the Member to UNICASH in the twelve (12) months immediately preceding the event giving rise to the liability and (ii) A$100; and
(b) UNICASH is not liable for any indirect, consequential, special, incidental, punitive, or exemplary loss or damage, including loss of profit, loss of revenue, loss of opportunity, loss of data, loss of goodwill, or business interruption, however caused.
17.4 Where consumer guarantees apply. Where a consumer guarantee under the ACL applies and the supply is not of a kind ordinarily acquired for personal, domestic, or household use, UNICASH's liability for failure to comply with that guarantee is limited (at UNICASH's option) to: (a) re-supplying the relevant service; or (b) paying the cost of having the relevant service re-supplied.
17.5 Disclaimers. Without limiting clauses 17.1 to 17.4, UNICASH is not liable for:
(a) interruptions, downtime, or unavailability of the Platform; (b) errors, defects, or delays in the Platform, in Receipt processing, in Gift Card delivery, or in any Draw; (c) failure or malfunction of any payment processor, Gift Card Provider, telecommunications network, internet service provider, OCR provider, email service provider, or device; (d) lost, late, misdirected, incomplete, or corrupted entries, Receipts, redemptions, communications, or notifications; (e) third-party content, products, services, or links (including the goods and services for which a Gift Card may be redeemed); (f) acts or omissions of third parties (including retailers, Gift Card Providers, Prize suppliers, and delivery providers); or (g) any loss caused by the Member's breach of these Terms.
17.6 Force majeure. UNICASH is not liable for any failure or delay in performance caused by events outside its reasonable control, including acts of God, fire, flood, storm, pandemic, epidemic, war, terrorism, civil unrest, strikes, governmental action, regulatory change, cyber-attack, telecommunications or internet failure, and third-party platform failure.
17.7 Indemnity. To the maximum extent permitted by law, the Member indemnifies UNICASH and its officers, employees, contractors, and agents from and against all loss, damage, cost, and expense (including reasonable legal fees) arising out of or in connection with:
(a) breach by the Member of these Terms, any Promotion-Specific Terms, or applicable law; (b) wilful misconduct, fraud, or negligence of the Member; (c) any Receipt submission, Gift Card redemption, or Draw entry made in breach of these Terms; or (d) any third-party claim arising from the Member's use of the Platform (including a claim by a Gift Card Recipient).
This indemnity does not apply to the extent caused by UNICASH's negligence or wilful misconduct.
18. Privacy and Communications
18.1 Privacy. UNICASH's collection, use, storage, and disclosure of Personal Information is governed by the Privacy Policy, which is incorporated by reference into these Terms. By using the Platform, the Member agrees to the Privacy Policy.
18.2 Service communications. By creating an Account, the Member consents to receive transactional and service communications from UNICASH, including: (a) account, billing, and security notices; (b) Membership renewal, payment, and cancellation notices; (c) Draw entry confirmations, winner notifications, and Prize fulfilment communications; (d) Receipt submission status and reward notices; (e) Gift Card redemption status and delivery notices; and (f) changes to these Terms, the Privacy Policy, or the Refund Policy. Service communications may not be opted out of while the Account remains active.
18.3 Marketing communications. Subject to the Spam Act 2003 (Cth) and the Privacy Act 1988 (Cth), UNICASH may send marketing communications by email, SMS, or push notification. The Member may unsubscribe at any time by using the unsubscribe link in any marketing email, by replying STOP to a marketing SMS, or by updating preferences in the Account.
18.4 Sender identity. Marketing communications sent by UNICASH will identify the sender and include functional unsubscribe instructions, in accordance with the Spam Act 2003 (Cth).
19. Changes to the Platform and Terms
19.1 Changes to the Platform. As provided in clause 5.3, UNICASH may modify, suspend, withdraw, or discontinue parts of the Platform at any time, subject to applicable law.
19.2 Changes to Terms. UNICASH may update these Terms. The current version will be available on the Platform.
19.3 Notice of material changes. Where a change is material and adversely affects active Members, UNICASH will give reasonable prior notice (for example, by email or in-Platform notification) before the change takes effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms. A Member who does not agree to a change may cancel their Membership in accordance with clause 6.5.
19.4 Correction of errors. UNICASH may correct any pricing, listing, Conversion Rate, Prize, Receipt reward, or other error on the Platform at any time. Where a transaction is completed at a manifestly erroneous price or value, UNICASH may, at its reasonable discretion, rescind the transaction and refund any amount paid.
20. Governing Law and Dispute Resolution
20.1 Governing law. These Terms are governed by the laws of [Western Australia] and the Commonwealth of Australia.
20.2 Jurisdiction. Each party submits to the non-exclusive jurisdiction of the courts of [Western Australia] and the courts of appeal from them.
20.3 Good-faith resolution. Before commencing proceedings (other than for urgent interlocutory relief), each party must use reasonable efforts to resolve the dispute by contacting support@unicash.com.au and engaging in good-faith discussion for at least 30 days.
20.4 ACL and regulators. Nothing in this clause prevents the Member from making a complaint to the Australian Competition and Consumer Commission, the relevant state or territory consumer affairs body, or the Office of the Australian Information Commissioner.
21. General
21.1 Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision is to be read down to the minimum extent necessary, or if that is not possible, severed, without affecting the validity of the remaining provisions.
21.2 No waiver. A failure or delay by UNICASH in exercising any right or remedy under these Terms does not operate as a waiver of that right or remedy.
21.3 Assignment. The Member may not assign or transfer the Member's rights or obligations under these Terms without UNICASH's prior written consent. UNICASH may assign, novate, or transfer its rights and obligations under these Terms, in whole or in part, to a related body corporate, successor, or acquirer of its business, without the Member's consent.
21.4 Entire agreement. These Terms (together with the Privacy Policy, Refund Policy, and any applicable Promotion-Specific Terms) constitute the entire agreement between the Member and UNICASH in relation to the Platform and supersede all prior representations, understandings, and agreements on the subject matter.
21.5 No partnership. Nothing in these Terms creates a partnership, joint venture, agency, employment, or fiduciary relationship between the Member and UNICASH.
21.6 Survival. Clauses intended by their nature to survive termination — including clauses 7.3, 8.6, 9.7, 9.8, 15, 16, 17, 18, 20, and 21 — survive termination or expiry of these Terms.
21.7 Notices. Notices to UNICASH must be sent to support@unicash.com.au. Notices to the Member may be sent to the email address registered to the Account, or by in-Platform notification.
21.8 Interpretation. A reference to a statute includes that statute as amended, replaced, or re-enacted from time to time. Examples are descriptive and not limiting.
